Gas graft: smugglers defraud Laos of taxes on 700 million liters a year

Citizens in Laos are calling for accountability after learning that gasoline smugglers and enablers in the government are defrauding the country out of taxes on 700 million liters (about 185 million US liquid gallons) of gasoline per year, sources told RFA.

Prime Minister Phankham Viphavanh revealed the extent of gas smuggling in an address to the National Assembly last week.

Laos is mired in perhaps its worst gasoline shortage in its history, exacerbated by rising prices, a lack of foreign currency and a rapid depreciation of Laos’ currency, the kip.

“According to our internal report, around 1.2 billion liters of gasoline is imported to our country [each year]. However, when we check with the exporters of both Thailand and Vietnam, they are sending us around 1.9 billion liters of gasoline,” Phankham Viphavanh said.

“Where are those 700 million liters?” he asked, accusing state officials and companies of corruption.

Members of the government who allow smugglers to get out of paying taxes should be punished, said Laotian sources, all of whom requested anonymity for safety reasons.

“This is an act of corruption. Those who want money will do whatever they can to get it and this will lead to a leak in government revenue,” a citizen of the capital Vientiane told RFA Lao.

“If the government can prevent this kind of problem, it will be better for the country. If they can find out the government officials and whoever else is involved, they should all be fined and fired,” the source said.

Another source told RFA that the country’s lax law enforcement allows corruption to flourish.

“There is no strong punishment for corrupt government officials in Laos. They just transfer them to other offices somewhere else. I am not sure if there will ever be a strong punishment for them,” the second source said.

“They are too flexible over this matter in Laos. If the government is serious about curbing corruption, they can do it and it will be good for our country. We have laws, but at this moment the laws can do nothing.”

A Lao analyst told RFA that Laos needs to set up an investigative committee to go after corrupt officials and expose them to the public.

“There is no accountable investigation and punishment from the relevant authorities,” the analyst said. “It is common to hear leaked information that the government found some people involved with revenue collection, but there is no punishment.

“This is why nobody is afraid of the law and the corrupt officials will just get more money.”

A proposal to immediately punish corrupt officials instead of reeducating them is under consideration at the National Assembly after it was introduced last week by Assemblywoman Valy Vetsaphong, who is also the deputy president of the Lao National Chamber of Industry and Commerce.

A Lao official who declined to be named said that the gasoline smuggling issue is under investigation.

“They are finding ways to solve this problem. The gasoline shortage still continues and it is a big headache for the government,” the official said. “We have already negotiated with our Thai trade partners to bring in more gasoline, but it will take time to return to normal.”

According to a May 2022 report from Ministry of Industry and Commerce, Laos imports around 100 million to 120 million liters of fuel a month on average. Thus, it costs around $600 million to $700 million to import enough fuel for one year.

However, prices are actually double in Laos due to the increasing price of oil on the world market.

Closed for price gouging

Gas stations in Laos that allegedly attempted to capitalize on the gasoline shortage by increasing prices have been closed for cheating their customers, sources told RFA.

“The authorities inspected all the gas stations in this province and found that three of them had been overcharging,” an official of the Industry and Trade Department of the northern province of Luang Namtha told RFA.

“They were selling gas at about 2,000-3,000 kip [$0.13-0.20] higher than the government price per liter. Our province has rules that control gas prices so we suspended those three gas stations,” he said.

There are however many gas stations that can only get fuel by buying it from abroad, and to do that, they need dollars or Thai baht. Due to a shortage of foreign currency, businesses cannot get as much as they need at the official rate from banks, so they must pay more for foreign currency from other sources. This, in turn, forces them to raise gas prices.

“We understand that the pumps get foreign currency from other sources and at higher rates but we have rules to abide by too,” the official said. “The owners of the three pumps will be fined 5 million kip [$333].”

A gas station owner in the town of Luang Namtha linked higher gas prices with higher exchange rates.

“We can’t get foreign currency from the banks, so we get foreign currencies … from private money exchange outlets at much higher rates. We can’t sell gas at the prices set by the government, we’ll lose a lot of money,” he said.

The gas shortage has forced small gas stations to close in Vientiane, leaving only the big companies in business, a motorist in the city told RFA.

“Only the large ones like Petroleum of Thailand and the Lao state fuel enterprise are able to be open,” the motorist said.

Authorities of the Industry and Trade Department of Champassak Province in southern Laos also inspected all gas stations in the province between June 21 and 28 and found seven gas stations were selling gasoline at higher prices.

According to the newspaper of Champassak Province, the authorities put locks on each gas pump, booked and fined the owners and sent them for reeducation.

According to the GlobalPetrolPrices.com website, the average price of gas in Laos was 28,070 kip per liter, or $7.13 per gallon as of June 27.

Nobel laureate Ressa vows to fight order to shut Philippine news site

MANILA, Philippine Nobel Peace Prize winner Maria Ressa pledged on Wednesday to fight an order by the corporate regulator to shut down her online news site Rappler, known for its critical reporting of President Rodrigo Duterte’s policies.

The ruling against Rappler, handed down by the Securities and Exchange Commission (SEC) on Tuesday, comes at a time when activists and journalists fear there will be no let up in challenges to press freedom under the presidency of Ferdinand Marcos who begins his term on Thursday.

“We will continue to do our jobs. Our reporters will continue to hold the line, will continue to report, and will continue to demand that access is there,” Ressa told a media briefing, in which she described the SEC decision as “intimidation”.

The SEC on Tuesday affirmed its 2018 ruling rescinding the operating licence of Rappler for violating foreign equity restrictions on domestic media when it sold depositary rights to a foreign entity.

Rappler had argued the Omidyar Network, the philanthropic arm of EBay founder Pierre Omidyar, was a silent investor. Omidyar cut ties by donating the depository receipts to Rappler’s staff.

“We strongly disagree with the (SEC’s) decision,” Rappler lawyer Francis Lim told the media briefing, adding there were legal remedies to question the decision and that the SEC could not enforce the order pending an appeal.

Asked about the SEC’s decision, a member of the communications team of President-elect Marcos said: “No comment for now.”

Marcos had shied away from debates and interviews in the presidential campaign, with critics complaining he has been inaccessible to media and some foreign journalists reporting they were denied accreditation for campaign events.

Ressa shared the 2021 Peace Prize with Russian investigative journalist Dmitry Muratov, a move widely seen as intended as an endorsement of free speech rights under fire worldwide.

Ressa is currently on bail after being convicted in 2020 for cyber libel in one of several cases against the website filed by government agencies.

“This is an effort to shut up Nobel laureate Maria Ressa, and shut down Rappler, by hook or by crook,” Phil Robertson, Deputy Asia Director, Human Rights Watch, said of the SEC order.

The Philippines ranked 147 out of 180 countries in the 2022 World Press Freedom Index, and the Committee to Protect Journalists ranks the Philippines seventh in the world in its 2021 impunity index, which tracks deaths of media members whose killers go free.

The government denies hounding media and says any problems organisations face are legal, not political. It says it believes in free speech.

Duterte’s spokesman did not immediately respond to a request for comment.

Land appraisal prices in Thailand to be raised in 2023

After a 12-month delay, the Thai Treasury Department will put into force a new national land appraisal price list for 2023-2026 on January 1st 2023. It will see the appraisal price for land in Bangkok rise by about 3% and in other provinces by an average of 8%.

Treasury Department Director-General Prapas Kong-ied hinted that some prices for next year will not be further adjusted unless there are significant changes in some land plots during the four-year period of the validity of the new land appraisal price list.

For instance, he said that the department’s appraisal price for land in the Siam Square shopping district is about 1 million baht per 4m2 (square “wah”), whereas the market price is about 3.5 million baht, in which case new pricing will have to be issued, in consultation with the Bangkok Metropolitan Administration, which is responsible for the collection of land tax in Bangkok.

Director of the Property Valuation Division Tananpong Suksomsak said that the increase of land appraisal prices will mostly affect land along the routes of train projects, new roads or in the Eastern Economic Corridor (EEC).

According to the new land appraisal price list, the highest appraisal price is 1 million baht per 4m2 for land on Silom, Ploenchit, Wireless and Rama 1 roads, 750,000 baht/4m2 for land on Sukhumvit Road, 450,000 baht/4m2 for land on Ratchadapisek Road, 300,000 baht/4m2 for land on Phetchaburi Road and 250,000 baht/4m2 for land on Phahonyothin Road.

For the rest of the country, the highest land appraisal prices are in Chon Buri, Rayong and Chachoengsao provinces and the EEC, mostly in close vicinity to the high speed train system stations.

Some of the new land appraisal prices are:

• Pattaya beach road in Banglamung district, 200,000-220,000 baht/4m2

• Sukhumvit Road in Muang district of Rayong province, 100,000 baht/4m2

• Rayong-Ban Khai road, up to 60,000 baht/4m2

• Muang district of Chachoengsao province, up to 50,000 baht/4m2

Chairman of the chairman of the committee for real estate development at the Thai Chamber of Commerce Issara Boonyoung, meanwhile, said that the Joint Standing Committee on Commerce, Industry and Banking will, again, submit an appeal to the government seeking to ease the land tax burden for business operators, by allowing them to pay the land tax in instalments without being fined.

Nearly 60 tonnes of suspect smuggled pork impounded in Nakhon Pathom

Thailand’s Livestock Development Department has impounded about 59 tonnes of pork, suspected to have been smuggled into the country, at a cold storage facility in Nakhon Pathom province today (Wednesday).

The department’s Director-General Sorawit Thaneeto said that inspectors searched the facility today, after the department had received information that it might be storing illegal pork from abroad.

The search uncovered 1,510 boxes containing legs of pork, weighing about 22,650 kgs, apparently originating in Poland, 80 more boxes of legs of pork from an unknown source, 1,433 boxes of pork bearing Brazilian brand “Seara”, 500 boxes of pork from Germany under the brand “Westfleisch” and 180 more boxes of pork from an unknown source.

Sorawit said that all the meat was impounded, by virtue of the Animal Epidemics Act, and the owner of the cold storage facility has been given 15 days to present, to livestock officials, an import permit and a permit for the transport of the meat. Failing that he will face legal action.

A number of pigs in Thailand succumbed to swine fever last year and this, prompting the authorities to designate areas of containment and enforce culling. The hoarding of pork and pork offal in cold storage facilities is rampant, contributing to the sky-high pork prices early this year, with a number of such facilities being raided and their contents impounded.

Modelo, Rebuilding Together and UFC provided Fight Capital Gym with a well-deserved revamp, including new jiu-jitsu mats, speed bag mounts, boxing bags and flooring, with the help of two of the biggest names in the industry. Former UFC heavyweight champion and longtime brand ambassador Stipe Miocic and UFC commentator Jon Anik lent their time and expertise to Fight Capital Gym by assisting with the renovations and providing members with a special seminar. Fight Capital Gym embodies the Fighting Spirit through its work with servicemen and women, free quarterly self-defense seminars and efforts to help members gain physical and mental empowerment through combat sports.

Following UFC International Fight Week, the initiative will go on the road with UFC fighters Justin Gaethje, Stephen Thompson and Dustin Poirier also joining Modelo, UFC and Rebuilding Together to help with renovations at local gyms in Denver, Charlotte and New Orleans. Gaethje, Thompson and Poirier are giving back to gyms in cities that have left a lasting impact on them as individuals and shaped who they are today as professional athletes.
